权利要求解释中主题名称作用的探析

The Exploration and Analysis of The Subject Matter Title's Function in the Claim Constructions

《专利审查指南》在解析权利要求构造时指出主题名称应予以"考虑",最高人民法院在"排水管道"案及《专利侵权司法解释(二)》中也认可了主题名称的限定作用,但在不同的发明中,主题名称是否均能够限定权利要求保护范围,以及如何理解其限定作用似乎仍然缺乏明确的规则,本文拟结合美国司法判例的经验,尝试在权利要求解释的语境下对主题名称的作用进行探索和分析。

When the GUIDELINES FOR PATENT EXAMINATION construed the structure of claims,it pointed out that the subject matter title should be emphasized. Even though the Supreme Court had admitted the restricted function of the subject matter title in the case of ＂Drainage pipeline＂ and THE SUPREME PEOPLE’S COURT ABOUT THE APPLICATION OF LAW IN PATENT INFRINGEMENT DISPUTE CASES（Ⅱ）, it still lacked the concrete rules about whether the subject matter title could define the protection scope of claims and how to understand its restricted function. This thesis, taking the judicial precedent experience of the United States for reference, attempted to explore and analysis the function of the subject matter title under the semantic atmosphere of claims construction.
