Path Choice and Institutional Guarantee of Energy Revolution from The Perspective of Law and Economics

能源作为公共资源的一种,兼具非排他性与竞争性的特点。"公"与"私"的糅合,阻碍了能源商品属性的回归,限制了能源市场体系的发展,导致了能源资源的利用效率低。为了解决上述问题,将我国由"资源优势"转变为"竞争优势",必须厘清能源革命的内涵,分析能源革命兴起的缘由,明确政府与市场关系的边界,重构能源市场价格调节机制。并从立、改、废方面入手构建现代能源法律体系。

Energy resource as one of public resources, has both characteristics of public non-exclusive and private competitive goods.The blend of ＂Public＂ and ＂private＂, hindered the return of energy commodity attributes, limited the development of energy market system, and resulted in low efficiency in the use of energy resources.In order to solve these problems, China will transfer the ＂resource advantages＂ into ＂competitive advantages＂, and then crack ＂resource curses＂, we must clarify the connotation of the energy revolution, analyze the causes of the rise of the energy revolution, clear the border between government and market relations, and reconstruct the energy market price adjustment mechanism.Also we should reform the management system of energy economy,and build a modern energy legal system from the aspects of legislation, reform and repeal.
