摘要
面对教育服务贸易全球化趋势的不断加强,各成员都试图在自身现实需求与利益保护之间寻求市场准入的平衡。但在多边贸易规则体系下,不同利益群体之间仍存在复杂的分歧与博弈,教育服务贸易市场准入的发展还面临诸多法律壁垒。未来要想有所突破,应充分利用好当前多边贸易规则体系的已有平台,发挥其它国际性、区域性公约和双边协议的作用,继续完善国内教育服务贸易涉外法律体系。而我国也应利用现有规则,适度开放,完善法规体系,建立与自身发展需要相适应的教育服务贸易法规体系。
Facing the trend of globalization of educational service trade, all members are trying to find the balance of market access between their real needs and interests. However, under the system of multi-lateral trade rules, there are still many differences and games between different interest groups, and the market access of educational service trade also faces many legal barriers. In order to make a breakthrough in the future, we should make full use of the existing multilateral trading rule system, play the role of oth-er international and regional conventions and bilateral agreements, and continue to improve the domestic legal system of foreign trade in educational services. China should make use of the existing rules, be mod-erately open and perfect the legal system, and establish a legal system of educational service trade that a- dapts to its own development needs.
