中国社会法治信仰的问卷调查分析

A Questionnaire Investigation into the Social Faith of Rule of Law in China

学界偏于对法治理论本身的规范研究,鲜有通过问卷调查对法治赖以建构的法治信仰做实证研究。通过问卷调查的方式对我国社会法治信仰尝试摸底调查,发现法律与人们日常生活既密切相关,也日益脱节。人们对法的态度也是矛盾的,他们希望在法律面前讲求平等,同时又对法的心理看法褒贬不一。大多数人相信只有政府带头守法,才能从制度源头上实现树立社会法治信仰。

Since the research community preferred normatic study of ＂rule of law＂ before, there are less empirical studies to the faith of ＂rule of law＂. The paper investigates the topic through questionnaire and finds that laws are both related and divorced with people＇s daily life. People＇s attitude toward ＂rule of law＂ is also paradoxical. People expect to achieve equality before law on the one hand, but they also take divided views to rule of law on the other hand. Most people believe that only through government＇s initiate can the faith of ＂rule of law＂ be actualized in society.
