摘要
《医疗事故处理条例》赋予了卫生行政部门监管医疗事故的法定职责,但由于其所规定的医疗事故报告制度存在报告主体设置的反人性、报告事项难以确定、报告本身的悖论等三大困境,医疗事故行政监管事实上步步落空。以江苏为例,2010年《侵权责任法》施行以后,医疗事故行政监管的地方规范也存在合法性问题和回避行政监管的困境,其结果是重民事轻行政责任、医疗事故失于防控。解决医疗事故行政监管的国家法困境和地方规范困境的出路是:地方立法。而在地方立法中需要:一是,以"医疗事故"为中心,赋予患者申请权与知情权、医学会报告义务和行政处理建议权,以有效监督行政监管;二是,规范卫生行政监管的实施。
Regulation on the Handling of Medical Accidents stipulates that department of public health supervises andchecks medical accidents. However,the drawbacks of the Regulation itself prevent the medical authority from ef-fective supervision in reality. Problems have been arisingin Jiangsu since the implementation of the Act of Tort Liability in 2010. The solution to this predicament calls for effective local legislation,i.e. to give patients the appli-cation right and the right to know,to authorize Medication Associations to report and give suggestions to adminis-trations,and to regulate the supervision and management of medical authorities.
