风靡全球的增强现实游戏《宝可梦出发》(<Pokemon Go>)存在各类法律风险。刑法上,游戏公司可能危害国家安全。游戏玩家可能危害国防利益或者妨害公共秩序。民法上,游戏公司可能侵犯玩家个人信息权。游戏公司与玩家也可能共同侵犯公民生活安宁权。玩家除了需要理性游戏避免法律风险之外,游戏公司应当将游戏区域限制在公共、适当、无危险的位置;以合法、合目的,以及符合比例原则的精神妥善使用个人信息;对游戏机制引发的人口流动进行预测、监控与引导以维护公民的生活安宁。

Hit augmented-reality game Pokemon Go has a number of legal risks. In criminal laws,the impolitic players may offend the national defence interest and public order while the producer company may damage the state safety. In civil laws the producers may violate the players＇ privacy and both of them may together offend individuals＇ right of peaceful life. Rationality is needed for players to avoid legal risks. Besides,the producers should limit the game zone in public,appropriate and no-danger areas. They should also do the personal information with legal and proper reasons while the proportion principle should also be met. And to eliminate the negative population mobility effects caused by the game,the producers should design carefully and prepare for the emergency situations.
