2012年刑事诉讼法的实施,使得警察以鉴定人身份出庭作证有了明确的法律依据,这种机制也逐步走向常态化。但实践中受各种因素的制约,警察以鉴定人身份出庭作证的比例不高,在应对律师时经验不足,没有做好足够的应对准备。本文从警察以鉴定人身份出庭作证的现状、律师询问技巧及应对技巧进行分析,论证了警察鉴定人应该加强心态上的转变,在回答问题时正面直接,提升对于行业规范的掌握程度,从容应对来自辩护律师的挑战。

The implementation of the Criminal Procedure Law in 2012 makes the police a clear legal basis to testify as appraisers, and the mechanism has gradually become normalized. But in practice, for various factors, the ratio of the police to testify as appraisers is not high because of insufficient experience in dealing with lawyers and preparation. This paper, from the status of the police to testify in court as appraisers, asking skills of lawyers and coping skills analysis, demonstrates that the police appraisers should strengthen the mentality of the change, answer the questions directly and enhance the degree of mastery of industry norms, and defense the challenges of lawyers calmly.
