环境污染第三方治理地方规范初论

Preliminary Discussion on Local Regulation of Third Party Governance of Environmental Pollution

我国环境污染第三方治理正处于"地方软法"治理阶段,从基本原则、适用领域、运作模式、配套制度等方面对这些地方规范进行了初步分析。由此观察,地方第三方治理面临着政府角色定位不明、治理机制不健全、监管体系不完善等现实困境。第三方治理在缺乏具体法律规制的背景下,亟需加快第三方治理地方性立法——规范地方实践;明确政府"合作者"的角色,通过正向的有力激励和反向的严格监管,协调好政企关系;从责任机制、合作机制等方面深入健全第三方治理机制;纵向上健全多元主体的严密监管体系,横向上强化每种具体监管方式的监管力度,从外部层面增强企业开展第三方治理的积极性。

Third-party governance of environmental pollution is in the ＂local sott ~aw＂ governance stage. We have made a preliminary analysis of these local standards from the aspects of the basic principles of governance, the application of the field, the mode of operation and the supporting system.According to this, we observe the local third party governance is facing dilemmas. The government＇s role is unclear, the governance mechanism is not perthat fect, the regulatory system is not perfect, and so on.Due to the lack of central legisla- tion in the third party governance, we need to speed up the improvement of the third party governance of local legislation, and then regulate the local practice.At the same time, we must make clear the role of government ＂partners＂, through the positive and negative incentives and reverse the strict supervision,and we need to coordi- nate the relationship between the government and enterprises.In addition, we should further improve the third party governance mechanisms from the responsibility mechanism, cooperation mechanisms and other aspects.To enhance corporate governance and actively carry out the third party, we need to improve the regulatory system of multiple subjects closely and strengthen supervision of each specific ways of supervision.
