On Armed Police Enforcement

从行为、权力根据、主体、法律属性、权力运行、法律程序方面剖析,并从人性道德和合法性方面考察有中国特色的武警执法:属于国家公权力的事实行为,但不是行政机构的行政行为,根本原因在于非行政主体履行职务行为,却为行政机关从事执法工作。武警执法既没有特定的行政目的,又没有可主动遵循的法定程序规则,还没有可行的行政法治轨道,在不知不觉中损耗法治价值,总体背离依法治国、依法行政的"依法"轨道,法治社会、法治国家和法治政府为此付出巨大的法治代价。

This paper analyses and investigates Armed Police Enforcement（APE） with Chinese characteristics from the aspects of human morality and legitimacy from behavior, power basis, subject, legal attributes, operation of power and legal procedures. APE belongs to factual behavior of national public power, rather than administrative behavior of administrative agencies, whose root cause is that non-administrative body fulfills their duties, but APE carries out work of administrative enforcement. APE has neither specific administrative purposes, nor legal procedures and rules to follow initiatively, nor feasible track of administrative rule of law. And APE unconsciously sacrifices value of rule of law. In the whole, APE departures from orbit of ＂rule of law＂ of running a country and administration in accordance with law. As a result, the society, country and government of rule of law will pay heave prices of rule of law.
