浅谈伊斯兰教法中的彩礼

Brief Discussion on Betrothal Gift in Shariah

伊斯兰教法中的彩礼,亦称聘礼。阿拉伯语"麦亥尔"的意译。即男方在婚前赠予女方一定的彩礼。这是男女婚姻成立的前提条件,否则,婚姻无效。这种聘礼是男方根据自己的经济能力自愿赠予给女方的,女方所获得的彩礼属于自己的私有财产。一旦赠予,男方将不能索回。研究从伊斯兰教法中彩礼的历史根源为切入点,通过对伊斯兰教法彩礼的属性、特征进行阐述,从而使人们认识到伊斯兰教法中彩礼存在的合理性。

The betrothal gift in the Shariah is the liberal translation of＂Mahr＂in Arabic,namely the gift presented by men to women before marriage,and this is the precondition for the establishment of marriage relation,otherwise,the marriage will be invalid.Such betrothal gift is presented by men to women voluntarily according to their financial capacity.The betrothal gift received by women is their private property.Once the betrothal gift is presented,the men cannot reclaim it.In this research,with the historical root of betrothal gift in Shariah as the entry point,the attribute and characteristic of the betrothal gift in Shariah are elaborated,so that people can realize the reasonableness of betrothal gift in Shariah.
