摘要
从法治的视野观之,封闭式住宅区内部道路公共化的本质是对住宅区内部道路进行的公物设置,是从"内部共有"到"社会公用"的转变。而在具体推进过程中,国家既可以通过采取行政征收、行政契约、民事契约的方式在取得内部道路的所有权之后进行公物命名,也可以跨过所有权转移,通过直接对业主内部共有道路的权利进行限制来设置公物。两种方式虽属于不同的法治路径,但都需要差异性地遵循公法上的法律保留原则、比例原则、目的正当性以及基本的程序正义等公法原则,以能保证在街区制推进过程中有效率且有限制地行使行政权。
From the perspective of rule of law,the nature of publicity of the internal roads of closed residential is to make the internal roads of closed residential become the public property,and the change from "owned by all of the internal" to "social utility".In particular advancing,the country can not only name after the public property after taking the ownership of internal roads by way of taking administrative expropriation,administrative contracts,civil contracts,but also limit the owners' rights to the internal roads and set it the public property across the transfer of ownership.Two ways belongs to different paths of rule of law,but need to follow principles of public law differentially,such as "Legal Reservation"、"Principle of Proportionality"、"Objective Justification" and "Basic Procedural Justice".the principle of public law principle of proportionality,legitimacy of purpose and basic procedural justice,So that to make the administrative power be exercised efficiently and restrictively in the process of block system reform.
