摘要
食品召回是针对缺陷食品而适用的一项法律制度,指当经营者发现其经营的食品不符合食品安全标准时,应当采取停止生产、停止销售等措施,以防止损害结果的发生或者扩大。我国的召回制度经历了漫长的发展过程,食品召回制度在《食品安全法》中的确立是食品安全的保障。食品召回制度的理论基础是保护消费者权益、企业承担社会责任、保证交易安全,这项制度具有公法属性和私法属性。
Food Recall is a legal system which applies to th e defective food.When the sellers find the food does not meet the food safety standard,they should take measures immediately to stop the production and sales to prevent the occurrence and expansion of harmful consequences.In China,the Product Recall System has experienced a long developing process and the Food Recall System was established in the "Food Safety Law".The theoretical basis of Food Recall System is protection of rights and interests of consumers,social responsibility and the trade safety. The Food Recall System has the public attribute and private attribute.
