摘要
现阶段我国环境行政执法与刑事司法衔接机制的立法较完善,但运行不佳,突出表现在环保部门有案不移、以罚代刑、公安机关立案及处理率低、检察院职能未发挥和法院职责缺失四个方面。究其原因,以行为主体的利益选择为视角来分析,在于该机制涉及的行为主体——立法者、环保部门、公安机关、检察院和法院的利益追求出现了冲突,加之违法责任追究成本较高,导致出现了"法的赤字"。完善我国环境行政执法与刑事司法衔接机制应做到:加强人大常委会的执法检查,明晰环保部门的监管职责,做好环保部门与公安机关工作衔接的基础工作,完善检察院的检察监督,发挥法院的司法保障职能。
At present,China's environmental administrative law enforcement and criminal justice legislation cohesion mechanism is perfect,but poorly run in the following four aspects:case not transferred,fine instead of punishment,inefficient in case processing,and dereliction of duty.The real reasons are the conflict among the lawmakers,the environmental protection department,the public security organ and the procuratorate,and the higher illegal cost. The perfection of environmental administrative law enforcement and criminal justice cohesion mechanism should be strengthening law enforcement and inspection of the Standing Committee of the NPC Environmental protection departments;clearing regulatory responsibilities;doing the basic work of environmental protection departments and public security organs work cohesion;perfecting the procuratorial supervision of Procuratorate;exerting the court's judicial guarantee function.
