辅助性原则视角下的自贸区监管模式

Supervision Mode of FTA under the Perspective of Supporting Principle

由注重事前审批到加强事中事后监管是上海自贸试验区重点改革事项,也是以政府职能转变为核心的一种新的法治模式,它要求"简政放权",去审批化,强调监管主体多元化、监管方式多样化、监管效力高效化。这一管理模式的转变是辅助性原则运用的具体表现,也是辅助性原则的两个规范化要求:私化即民营化,公化即公共化的体现。重审批和强化事中事后监管的精神实质,不能仅仅限定在政府管理领域去理解,而应当将其作为一种自贸区管理的制度创新模式,即将自贸区作为一个管理整体的角度而论之。这时应引入辅助性原则对自贸区事中、事后监管模式做原则性把握。

The transformation from the focus on examination and approval in advance to the strengthening of supervi- sion in process and afterwards is the key reform issue in Shanghai Pilot Free Trade Zone, and also a new mode of rule of law with the core of transforming government functions. It requires ＂ streamlining government and delegating authorities＂, removing examination and approval, and emphasizing diversification of supervision subject and meth- ods, and efficiency of supervision. This transformation of management model is the specific performance of the ap- plication of supporting principle and also the embodiment of the two standard requirements （ privatization and publi- cization） of supporting principle. The spiritual essence of the focus on examination and approval in advance and the strengthening of supervision in process and afterwards cannot just be limited to the field of government management to understand, but should be regarded as a system innovation model of free trade area management, which means to take free trade area as a whole management. At this time, supporting principle should be introduced for the princi- pled grasp of FTA＇ s supervision mode in process and afterwards.
