摘要
"大学章程现象"是指各大学章程趋同以及章程在大学治理过程中被束之高阁的现象。制度学派的理论框架和集体行动理论对章程现象有一定的解释力。破解章程现象,需要加强章程宣传,实施大学文化引导;需要完善大学纪律建设,建立章程运行监督机制;需要统一章程的价值观念,进行大学管理模式变革。三者的基础在于,需要大学的卓越领导。卓越领导需要组织信任,组织信任意味着对章程的信任。以章程现象的理论分析和破解之道为基础,可以建构大学章程建设模型,在理论上助力章程成为大学治理的习惯。
The "Phenomenon of the University Statutes" is that University Statutes become convergent and are laid aside' and neglect in the course of university governance. The phenomenon can be explained by the theoretical framework of institutional school and the theory of collective action. In order to resolve this phenomenon, it is necessary to strengthen propagandize of the University Statutes through the university culture guide; to improve the university discipline construction, establish the supervision mechanism of the University Statutes; to unify the values of the University Statutes and to change the university management mode. The above three measures are based on the excellent leadership of universities. Excellent leadership needs to organizational trust that means the trust of the University Statutes. On the basis of the theoretical analysis and the explanation of the University Statutes phenomenon, a model of the University Statutes can be constructed, which helps the University Statutes to become a habit of university governance theoretically.
