论“最低关联法”在仲裁员独立性案件中的适用

The Application of de Minimis in the Case of Disqualifying the Independence of an Arbitrator

"最低关联法"被国际投资仲裁庭视为判断仲裁员独立性的重要方法之一。一方面,"最低关联法"作为补充性手段用以辅助对仲裁员独立性资格的质疑;另一方面,"最低关联法"作为替代性方法以进一步判断对仲裁员独立性资格的质疑。"最低关联法"将在确保投资仲裁程序的公正、裁决的正当性以及当事方利益的实现方面继续发挥关键作用。

On the background of the further development of globalization and following high frequency of international investment dispute, how to guarantee the independence of arbitrators so as to ensure the legitimacy of awards has become the core issue in international investment arbitration. On the basis of analyzing numbers of awards in international investment arbitration, the paper concludes that the arbitral practice has explored the test of de minimis. The co - arbitrator has two tendencies when applying de minimis： one is complementary means aiming to support disqualifying an arbitrator; the other is alternative ways to uheriorly analyze the disqualification.
