网络直播相关著作权问题研究

互联网的普及和发展催生了网络直播这一种新兴的方式,这对立足于传统版权的著作权法带来了新的问题,这一新技术带来的便利值得肯定,但其中所涉及的著作权问题需引起关注。网络播放可分为三类,即网络直播,网络广播,网络点播。网络直播的著作权保护盲点较多,应以"广播"行为来定性网络直播行为。对于网络直播所带来的著作权问题,涉及著作权人、广播组织和其他邻接权人等的权利归属界定问题,应首先在原有的法律条文内,拓展现有含义,进行深入研究,比如通过广播组织权中的转播权;其次,可以借鉴他国的立法经验,来规范通过网络向公众传播视频的权利。
