摘要
由于检察机关和环保部门的职能不同,二者在公益诉讼中的定位也应当有所区分。环保执法部门在行政执法中发挥着不可替代的作用,同时也存在"违法成本低"、"处罚力度小"这一事实,行政处罚手段与诉讼手段所惩治的内容、受益的主体以及社会效果都是不同的。利用环保部门对环境监测的信息优势,对环境污染事件进行行政处罚的同时,将损害社会公益的案件移送检察机关进行环境公益诉讼,也是对环境保护采取的一个强硬手段。通过建立信息共享平台,完善检察机关的检察监督机制和环境污染案件的移送制度,实现环保部门的执法活动与检察机关提起环境公益诉讼程序的无缝衔接,有利于环境保护在司法上的不断完善。
As the functions of procuratorial organs and environmental protection departments are different, the position of the two should also be differentiated in the public interest litigation. Environmental law enforce-ment departments play an irreplaceable role in the administrative law enforcement, but also there exists the fact of "low cost in being illegal" and "punishment being small". The penalty content of administrative punish-ments means and litigation means, the main beneficiary and social effects are different. With the information superiority of environmental protection departments on environmental monitoring, we should carry out admin-istrative punishment, and at the same time, transferring the cases of damaging the social welfare to the prose- cution to conduct environmental public interest litigation should also be a tough way to protect the environ- ment. Through the establishment of information sharing platform, improving the procuratorial supervision mechanism and the transfer system of environmental pollution cases, we should promote the law enforcement activities of environmental protection departments and procuratorial organs to bring environmental public in-terest proceedings seamlessly, which is conducive to the continuous improvement of environmental protection in the judiciary.
