摘要
经过三十多年发展,我国对检察人员行为规范已初具规模,对检察权规范运行起到了一定的作用。但不容忽视的是当下检察人员日常行为规范化建设中存在规范体系散乱、对检察人员行为规范方面的培训教育欠缺、行为规范责任主体不明确及部分行为规范运行机制处于失灵状态等问题,同时面临检察改革后检察人员分类管理的挑战。在司法改革背景下,检察人员的日常行为规范化建设应当首先完善检察人员日常行为规范体系,并从认知、组织、制度及技术等层面,对检察人员日常行为规范进行机制建设。通过考核评价机制、检务督察机制加强内部监督,通过权力机关的依法监督、人民群众的参与性监督和新闻舆论监督等加强外部监督。
After the development for more than 30 years, our country has already begun to take shape to the procuratorial personnel's behavior standard, which has played a certain role to the procuratorial power standard operation. But there are some problems in the standardization of the dtiily behavior of procuratorial personnel which cannot be ignored, for example, regulation system scattered, normative behavior training and education are lack, the responsibility subject of code of conduct is not clear, and some codes of conducts do not work. And the system also faces the challenge classified management of procuratorial personnel after procuratorial reform. Under the background of judicial reform, we should improve the daily behavior norm system of procuratorial personnel firstly,and construct the mechanism in cognition, organization, system and technology. We should also strengthen external supervision through the evaluation mechanism, the procuratorial supervision and strengthening internal supervision mechanism, the supervision of the authority and people' participation in supervision and media supervision.
