摘要
在对中国与国际体系关系的研究中,"遵约"行为是一个备受关注的焦点。本文借鉴中外学者对"遵约"问题研究的一组学术对话,在国际人权机制领域进行了理论印证。研究发现,中国参与国际人权机制的四个历史时期中渐次出现了"程序性遵约"、"行为遵约"、"制度遵约"、"政治遵约"、"社会遵约"的特征,并且随着中国遵约程度的加深,依次获得了体系的"形式承认"、"分配承认"和"价值承认"。被体系认可的中国把自身的价值观带入体系发展中,自然引发"体系变革",由此形成了"参与实践"—"体系承认"—"体系变革"的完整实践过程。
Based on the studies of the relations between China and international institu- tions, this article reviews the process of China's engagement with the international human rights institutions. China's compliance behaviors take on five periodic features at the four historical sta- ges. From procedural to behavioral, and then organizational, political, till social compliance, China gets recognition of the international human rights institutions. On the other hand, the in- ternational institutions gradually recognize China in forms, distribution rules and values. With the development of engagement and recognition, China brings innovative conceptions and re- forms to international human rights institutions. Therefore, the logic linkage between state en- gagement and system coevolution has been proven in this case study.
