政府对投资科技产业的企业进行补贴是政府以私法化的方式履行职责的表现,本质上属于行政给付行为。我国应强化人民代表大会通过预算审批对政府补贴实施的合法性控制,完善补贴的预算执行监督机制和行政公开制度,激活司法机关监督权能,并通过合同方式补强行政机关对投资及其亏损事实的调查权。

The government＇s subsidy to the enterprise of the investment in science and technology industry is the performance of the government to perform its duties in the form of private law,which is essentially an administrative payment behavior.China should strengthen legitimate control to government subsidies implementation of People＇s Congress through budget approval system,improve the subsidy budget implementation supervision mechanism and administrative public system,activate the judicial authority to monitor the power,and strengthen the administrative organs＇ investigation power to the investment and losses through the contract.
