摘要
建筑物所有权的无期限性与土地使用权的有期限性,这两者的冲突使土地使用权和建筑物所有权相分离。为解决此矛盾,《物权法》第149条规定住宅建设用地使用权期间届满,自动续期。但这并未解决自动续期是否有偿、费用如何计算、续期期限等问题。有偿续期更符合建设用地使用权他物权的性质。按续期时土地增值价款的一定比例收取续期费用,更利于社会公平,以建筑物剩余寿命为标准确定续期期限,能真正地保障"居者有其屋"。
