论公共图书馆对孤儿作品的数字化使用——《公共图书馆法(征求意见稿)》的完善

On the Digital Use of Orphan Works in Public Libraries——The Improvement of Public Library Law(Draft for Soliciting Opinions)

受制于版权问题,公共图书馆面临着大量馆藏孤儿作品无法数字化使用,客观上阻碍了其数字化建设,延缓了其事业发展。鉴于《著作权法》最新修法动向已针对孤儿作品的数字化使用作出了具体规定,作为同样纳入立法者视野的《公共图书馆法》应当与其紧密衔接,从严谨措辞、规范定义、细化分类、查找标准、备案制度等方面完善孤儿作品的相关规定,以求在数字环境下更符合公共图书馆收集、保存、传播文献的基本职能,更加契合为公众提供数字化服务的现实需要。

Lots of orphan works can＇t be used digitally by public library because of the limitation of copyright issues, which objectively set obstacles for digital resources construction and delay the librarianship development. In view of the latest amendments of copyright law in the specific regulations on digital orphan works, the public library law should keep pace with the adjustment in the following aspects of careful wording, unambiguous defini- tion, detailed classification, search criteria, filing system, etc. Thus, it will be more in accordance with the basic functions of public library collection, preservation and dissemination of documents under the digital circumstances and meeting the realistic needs for providing digital services.
