The New Development of Criminal Law in China

近年来,我国刑法学研究获得了长足的发展,在基础理论问题和实务问题上都展开了深入而又广泛的探讨和研究。主要梳理我国2010—2015年期间刑法学研究的重要内容及其学术观点。在刑法学基础理论问题方面介绍了犯罪论、违法性论、刑法解释学与刑罚论;在重大现实问题方面介绍了劳教废止后的刑法应对与死刑改革问题;在热点罪名方面主要介绍《刑法修正案》(八)、(九)所涉及的危险驾驶罪、贪腐犯罪、恐怖犯罪等罪名。由此勾勒出我国刑法学最新发展的动态和脉络。在此基在础之上,总结并评价我国刑法学科前沿发展的总体状况及发展趋势。

In recent years, the research of criminal law in our country has made considerable progress, the research which based on theoretical problems and practical problems are discussed and studied deeply and widely. This paper mainly studies the important contents and academic point of views of criminal law in China from 2010 to 2015. In the basic theories of criminal law, the paper introduces the crime theory,the criminal illegality theory, the interpretation theory and the penalty theory; on the major practical problems introduces the rule of law after the abolition of Laojiao system and the problems in the reform of death penalty; and introduces the hot charges involved in the amendment （IX）and the amendment （VIII）of the Penal Code, which includes the crime of dangerous driving , the corruption crime and the terrorist crime. Then the paper outlines the latest developments and dynamic contexts of the criminal law of our country. On this basis, summarizes and evaluates the overall situation and development trends of the frontier development on the China＇s criminal law in recent years.
