摘要
器官捐献同意模式关系到捐献者合法权益和可供移植的器官数量,历来备受关注。通过对知情同意、代理同意和推定同意三种器官捐献同意模式研究,分析我国现行的法律规定、三种同意模式的划分,每种同意模式的适用范围、适用条件、可能存在的问题以及在器官捐献立法和器官捐献实践中的意义。旨在为完善我国器官捐献立法和减少器官捐献者的困惑,推动器官捐献程序的顺利进行。
The consent model of organ donation has been focused on because it relates to the donors＇ legitimate rights and interests and the number of organs available for transplantation. Through studying three consent models of organ donation of informed consent model, proxy consent model and presumedconsent model, the article analyzed the current law regulations, the division of three consent models, the applicable scope, applicable conditions and possible problems of each consent model, and the meaning in actual organ donation legislation and the application in organ transplantation practice. The purpose is to improve the legislation of organ donation in China, reduce the confusion of organ donors, and promote the smooth progress of the organ donation program.
