摘要
消费者在与经营者签订消费合同时的意思形成上的障碍、为了追求合同真正自由的目的以及出于消费者的这一弱势群体身份而给予消费者以倾斜性保护,这些都是消费者撤回权制度产生的法学理论基础。追求效益大于成本的法经济学以及消费者的消费行为策略和消费心理也呼吁消费者撤回权法律制度的建立;同时消费者撤回权法律制度的建立也能促使经营者提供更好的商品和服务,展开良性竞争。
Formation of the meaning of consumers is hindered in the consumer contract when the consumer signed with the operator, to pursue the real freedom of contract and give consumers to tilt protection. These are the law theory foundation of the Consumer's Right of Withdrawal. Pursuit of efficiency is better than the cost and consumer's behavior strategy and consumer psychology also called for the establishment of the legal system of the Consumer' Right of Withdrawal. At the same time the establishment of the legal system of Consumer' Right of Withdrawal also can impel the operator to provide better products and services, to compete healthy.
