完善知识产权制度环境提升我国创新主体的创新能力

Improving the Innovation Ability of Chinese Innovators by Perfecting Institutional Environment of IP System

根据中共中央、国务院发布的《国家创新驱动发展战略纲要》,我国的创新主体主要包括企业、科研院所、高校、社会组织等。提升我国创新主体的创新能力,意在解决我国在科技创新方面的弱势地位问题。通过完善我国知识产权制度环境来提升我国创新主体的创新能力,需要针对知识产权创造、运营、保护和管理制度中不适应创新经济关系要求的部分探讨相应的完善对策,具体包括4个方面:一是完善有利于知识产权创造的社会环境、人才培养与激励环境;二是完善知识产权运营环境;三是完善知识产权保护环境;四是完善知识产权利益分配管理制度环境。

According to The Outline of National Innovation DHven Development Strategy issued by the CPC Central Committee and the State Council, Chinese innovators mainly include enterprises, scientific research institutes, universities, social organizations and so on. The purpose to improve innovators＇ innovation ability in China is to solve the problem that China is at a weak position in the field of science and technology innovation. One way to improve innovators＇ innovation ability is through perfecting the environment of IP system, which in turn, requires improvements on any parts non-adaptable to the innovative economic relationships within the four aspects of IP system： the creation system, the operation system, the protection system, and the management system. Perfecting the environment of IP system involves four aspects. Firstly, to prefect the environment for IP creation, including the social environment as well as the talent cultivation and incentive environment. Secondly, to perfect the environment for IP operation. Thirdly, to perfect the environment for IP protection. Fourthly, to perfect the environment for the interests＇ distribution management system of IP.
