民间借贷案件适用小额诉讼程序的实证分析

An Empirical Analysis of Small Claims Procedure to Private Lending Cases

大多数民间借贷案件符合小额诉讼程序要求的"事实清楚、权利义务关系明确、争议不大"的标准,因此小额诉讼程序非常有利于解决民间借贷案件的诉讼拥堵问题。针对民间借贷案件在适用小额诉讼程序中存在的诸多阻力和疑难之处,我们以神木县法院审理的362件民间借贷案件为实证样本,分析了民间借贷案件适用小额诉讼程序的实际情况。提出应当适当提高适用标的额标准,增加当事人选择适用的权利;做好释明工作以减少当事人的适用顾虑;完善考核机制与调解机制减轻法官的审判压力;明确不适用的情形,完善与其他程序的衔接和其他操作规范。

By empirically analyzing 362 private lending cases in Shenmu county of Shanxi Province, we study the small claims procedure （SCP） to private lending cases. We found that most private lending cases are consistent with the standard of ＂clear facts, unequivocal rights and obligations, and little dispute＂ required by SCP. Applying SCP to private lending cases may greatly alleviate the litigation congestion problem. Regarding the resistance and difficulties in applying SCP to private lending cases in practice, we suggest that the courts raise the standard of target amount, allow parties＇ voluntary choice of SCP when mandatory application does not apply, and clarify its connections to other procedures and operational standards.
