Research of Strengthening Legislation Procedure Construction of Local Government

程序规范是实体正确的前提和基础,政府立法应当重视程序规范。从地方政府立法实践看,无论是项目选择,还是起草、审查、协调、决策和公布环节,都存在一些不尽如人意的问题。加强政府立法程序建设,关键是要把握好立法的选题、草拟、审查、审议、公布五个环节,并在这五个环节完善制度、细化程序,走出具有中国特色的地方政府立法的新路子。

Procedural norms are the premise and basis of entities performing correctly. Government legislation should put emphasis on procedural norms. From the perspective of the legislation practices of local government,there are some unsatisfactory problems either in project selection or in the phases of draft,review,coordination,decision and publication. The critical point for strengthening the legislative procedures of government is to properly handle with the five phases,namely subject selection,drafting,review,discussion and publication. It is also required to improve system and refine procedures in these five phases to find a new way of local government legislation with Chinese characteristics.
