Comparative Study on Legal System of Science Sponsorship and Management

纵观发达国家对基础科学研究活动进行资助和管理,其思路和方法有相同之处,在法律体系结构、主要制度设计上有不少相似之处,应当说这些经验做法是在长期发展中摸索出来的,对提升一个国家或地区的科学技术发展战略水平、科研质量和科研管理水平是有重要作用的。本文对五个主要发达国家的基础科研基金管理的法律制度进行梳理和分析,对法律规范框架和层次、项目设定权、依托单位定位和责任、复审与救济程序和法律责任等几个重要问题进行深入探讨,以期对我国相关基础科研管理法律制度的完善有所参考。
