Using Legal Interpretation to Analyze Connotation of Crowd Gathering in Criminal Law

法学作为以法规范为研究对象的学科,其重点在于对法规范的解释与适用。"聚众"一词作为刑事法律规范中一重要术语,由于概念的模糊性,致其存在复数解释之可能性,为实践操作带来了一定的困扰。以文理解释为基础,以比较解释及逻辑分析为手段,参照生活逻辑原则,基于公众认同感,寻求法律解释对概念阐明时的法律效果与社会效果之均衡,对"聚众"一词进行合乎法理的判断。

Law studies is such a discipline that addresses mainly the problem of defining and applying legal norms.Crowd gathering is a key terminology in criminal law.However,this concept is not appropriately defined.For instance,it could be conceptualized as plural objects.Thus,its application could hardly precisely defined either.The present study endeavors to make a logical analysis of this term on the basis of literal interpretation and comparative interpretation,as well as the public’s common sense,while seeking the balance of legal effect and social effect.
