死刑存废之民意分析

Analysis of Public Opinion on Death Penalty Abolition

放眼全球,许多国家已经不存在生命刑,死刑的废除已成为各国刑罚发展的潮流。我国在处理死刑问题上,学界达成的基本共识是严格限制死刑适用,逐步废除死刑。而我国仍保留死刑的一个重要原因是民众的意愿。民意成为废除死刑的主要障碍和保留死刑的重要理由主要原因在于民众的愤怒心理和报应观念等。针对此,我们亟需从寻求死刑替代措施、司法公开、舆论积极回应民意、发挥法律人的社会责任等方面对民意进行正确的引导,以期尽早通过合情合理的方式解决我国死刑存废难题。

There has been no longer any life penalty in many countries across the world with the development of national penalties,and death penalty abolition has become the trend as a result.In China,most scholars working on this issue agree to strictly limit its application,and terminate it gradually.However,one of the obstacles is the public’s traditional idea.People generally hold that that the criminal shall pay his life for taking others’.The present study proposes strategies to resolve this problem,such as seeking alternatives,publicizing information,responding actively to public’s opinion,and strengthening practitioners’social responsibilities.
