政府大楼“门禁制度”的宪法学分析

The Constitutional Law Analysis of Government Buildings“Entrance Guard System”

"门禁制度"本是以安全要素考虑为先而设立的,但针对政府大楼实行的"门禁制度",从政府的角度来说,或是为了公共安全利益着想,然而基于公民的角度来说,恐有违背平等和自由原则之嫌。文章试图通过宪法原则分析法、利益衡量法两种不同的宪法分析法,对政府大楼"门禁制度"进行分析,以探寻平衡其间价值冲突的合理路径。

The entrance guard system, this is a safety factor considering the first set, but in view o! the government building of entrance guard system, from the point of view of government, or for the sake of the public security interests based on the citizen＇s point of view, however, may have a deviation from the principle of equality and freedom. This article attempts through the constitution principle analysis and method of interest measure two different constitution analyses on entrance guard system of government buildings, is analyzed, reasonable ways to seek balance in value conflict.
