摘要
"电摩"新国标和"禁电限摩"规定的实质,是"电摩"的路权问题,具体表现为"电摩"与汽车的路权之争。权利探究应该回归权利本身,从路权形成的逻辑基础、分配原则以及对应的法制类型分析"电摩"的路权,更有利于解决"电摩"的路权问题。"电摩"是弱势群体实现自己合理交通需要的工具,公平的路权分配原则和"人本-自由型"路权法制类型,要求保障不同群体特别是弱势群体合理交通需要的满足。
The new national standard of electric motors and the restrictive provisions on them in nature are concerned with the right-of-way of electric motors, the specific presentation of which is the dispute over right-of-way of cars and electric motors. Inquiry of right should return to the right itself. Analyzing the right-of-way of electric motors from the formation of its logic foundation, distribution principle and the corresponding legal types will be more conducive to solving the problem. Electric motors are traffic vehicles for social vulnerable groups. The fair distribution principIe of right-of-way and human-based legal type require the satisfaction of the reasonable transport needs of various groups especially social vulnerable groups.
