摘要
"贾敬龙案"中认定"蓄谋杀人"对死刑立即执行的判决起到了重要的作用。英美刑法中的"谋杀罪"以及我国唐律中的"谋杀"都是将预谋作为故意杀人罪的加重罪名加以考量。与之不同,在我国司法实践中,"蓄谋"杀人被作为酌定加重情节考量。在对"蓄意"的理解上,不应当从时间间隔长短的角度进行考察,应当考虑的核心问题是,行为人的准备行为本身值得刑法评价,从而实行行为构成的罪名被吸收,从严处罚。
In the case of Jia Jinglong,the element of murder plays a part in the penalty of Sentence of death. The crime of murder in anglo-american criminal law and murder in Tang Dynasty＇s law,murder is seen as the aggravating circumstances of homicide.To understand premeditate,the element of time should be seen as the core.The question should be considered is,if the preparation behavior deserves the comment of criminal law,thus raise the penalty.
