摘要
本文以重庆江津区及江苏新沂市为典型地区,分析了流转型土地经营权抵押贷款的运行机制及其改良方案。研究表明,土地租金年付制导致流转型土地经营权抵押贷款面临着土地经营权不稳定性的矛盾。与此同时,由于土地股份制不仅生成成本高,而且运行成本也不低,致使基于土地股份制的农地抵押贷款难以在实践中推行。为此,本文提出引入土地银行制度,充分发挥银行"散存整贷"、"短存长贷"的功能,在促进土地流转的同时增强流转型土地经营权的稳定性,为农地抵押贷款创造有利条件。
Taking two typical districts, Jiangjin of Chongqing and Xinyi of Jiangsu, as sample, this paper explores the mechanism and its improvement schemes of transferred land management rights-based mortgage loan (TLMRML). It indicates that since the popular form of land lease contract is annual pay system, TLMRML at present is confronted with an inner contradiction which is that the endogenous instability of transferred LMR has hindered the implement of TLMRML. Furthermore, both the costs of generating and running land joint stock system are so high that LMR-based mortgage loan built on land joint stock system can hardly be practiced. Therefore, this paper proposes that land banking system can be set up to accelerate land circulation and strengthen the stability of transferred LMR, which will create a favorable condition for implementing farmland mortgage.
