专利制度焦点变迁及其演进协同管理研究

Study on Changes and Evolution of Focus of Patent System and Their Synergy Management

本文分析了主要发达国家和发展中国家专利制度发展概况,总结了各国专利制度从特色到融合的动态演进过程特点,提出目前专利制度协同管理主线,包括:专利申请数量与专利申请质量协同;专利制度国家特色与国际标准的协同;专利制度与产业政策及区域政策的协同;专利存量的利用与专利增量的开发协同等。从差异中走向融合,在融合中保持差异,可以大略概括为世界专利制度的改革走向,这为中国专利制度协同发展提供了参考。

This article analyzes the profiles of patent system in developed and developing countries, concludes the dynamic evolution tendency of transferring from distinction to integration and proposes that currently, the mainstreams of synergy management of patent system are ： synergy between patent quantity and quality ; synergy between country-specific patent system and international standard patent system; synergy between patent system and industrial and regional policies; and synergy between utilization of patent stock and development of patent increment. Stepping from differentiation to integration and meanwhile keeping their own characteristics in the converging process can be roughly used to describe the trend of world patent system reform, and all these provide good reference for China＇s patent system synergy development.
