侦查阶段辩护律师诉讼权利的保障程度,对有效地发挥律师的作用,维护犯罪嫌疑人的合法权益,发展和完善司法制度有着重大而深远的意义。通过对S省的实证研究发现,侦查人员的执法理念和具体的执法过程都具有明显的进步性,但依然存在若干问题,影响了辩护律师辩护职能的发挥和司法改革的进程。通过分析找出影响法律实施的立法因素和实践因素,提出改革的思路和方案是破解诉讼权利的保障难题的关键。

The extent of lawsuit rights protection of defense counsel in the phase of investigation is of pro- found influence on the execution of counsel＇s function, the legal interests protection of criminal suspects and the de- velopment and improvement of judicial system. By conducting an empirical research in S province, we find that the concepts of law enforcement investigators and the specific investigation process have all improved a lot. However, there still exist some problems that may affect the execution of counsel＇s function and the process of judicial reform. By analyzing the legislative factors and practical factors that affect the implementation of law, we propose some ways or plans to solve the problem of rights protection of defense counsel.
