摘要
长期受政府管理模式的支配,我国劳动行政执法形成了行政主义的压制型模式。该模式面临资源短缺、成本高昂、实效性差等诸多危机,无力回应执法实践的诉求。治理型劳动行政执法模式以治理理念为指导,践行多元主义、合作规制、柔性治理等基本思想,能有效克服压制型模式的不足。应立足于治理逻辑,从执法理念的变革、多元协同执法主体体系的再造以及柔性执法方式的建构等方面,推进劳动行政执法模式的转型。
Dominated by the Almighty government management mode, the labor administrative law enforcement has formed a government centered repressive model. The model is facing a shortage of resources, high cost and many other crises, unable to respond to the demands of law enforcement practice. Governance type labor administrative law enforcement mode by governance theory as the instruction, practice of pluralism, cooperative regulation, the basic idea of flexible management, can effectively overcome the insufficient suppression mode. We should base on the logic of governance, promote the transformation of the mode of law enforcement from the perspective of the reform of the concept of law enforcement, the reconstruction of the main body system of multiple cooperative law enforcement and the construction of flexible law enforcement methods.
