罪犯矫正契约化推进中的障碍分析

罪犯矫正契约化需要社会契约思想和广泛的社会认知基础的支撑,需要有社会制度的合理性设计。我国由于传统价值观念的惯性作用,契约思想并没有成为社会的主流思想和价值理念,没有渗透和应用于中国社会基本制度的构建。在重刑主义思想影响下,迷信严刑峻法对社会的治理作用,缺乏罪犯矫正教育平等性的人文情怀和主体性观念,罪犯没有被置于矫正教育活动的主体地位。因此,罪犯矫正契约化首先需要培育社会对待罪犯的宽容性。

The contract education of criminals requires the support of social contract thought and the broad social cognitive foundation, which requires the rational design of social system. Because of the inertia effect of traditional values, the idea of contract has not become the mainstream idea and value of society, and has not penetrated and applied to the construction of the basic system of Chinese society. Under the influence of the idea of factionalism, the supernatural powers need the supernormal punishment of the law, the society is short of equality of humanistic feelings and subjective ideas, criminals are not placed in the main position of corrective education activities. Therefore, the criminal contract correction should first of all need to cultivate social tolerance to crime.
