痕迹鉴定意见作为证据种类的一种,具有证据的基本属性,但要成为被法庭采信的科学证据,仍需诉讼双方的有效质证。在目前痕迹鉴定意见质证内容存在问题的基础上,提出将鉴定主体的资质、过程的规范性、鉴定意见书及其与其他证据之间关系等作为完善痕迹鉴定意见质证的要点。

The trace appraisal opinion is one of evidence types which have the basic attributes of evidence, but when it should be adopted by the court as scientific evidence, it still need effective cross-examination. This article explores the problems existing in the content of cross-examination from the current appraisal opinions, and then puts forward the points of perfecting the evidence of the identification of the traces, such as the identification of the subject qualification, the normative process, the appraisal opinion paper and its relationship with other evidence.
