当代中国网络公共领域的现实境遇与发展思路

Real Conditions and Development Ideas of Network Public Sphere in Contemporary China

我国网络公共领域的生成恰逢时代契机:国家和社会相对分离以及民主化程度的提高是根本前提;庞大网民群体的形成奠定了公众基础;W eb2.0时代网络的开放性、交互性奠定了技术基础。但同时也面临着现实困境:网络世界不平等是现实世界不平等的延伸;国家必须对网络发挥主导作用,市民社会尚不成熟;网民理性不足,司法规约困难;商业化、娱乐化、私人化倾向损害了网络公共领域的基础。有鉴于此,政府应该做到不缺位、不越位;网络商业主体应该提高法律意识和责任意识;网民应该提高参与能力和参与意识。

The generation of China＇s network public sphere coincided with the era opportunity： the relative separation of the state and society and the improved democratization are fundamental premises; the formation of a large group of netizens lays the public foundation; openness and interactivity of network in Web2.0 era lay technical foundation. But at the same time it faces real difiqcuhies： the network world inequality is an extension of the real world inequality; the state must play a leading role in the network, as the civil society is immature; netizens are not rational enough, and judicial regulation is difficult; commercial, entertaining and personal tendency damages the foundation of network public sphere. Given this, the government shall make no absence or offside; network business subjects shall improve the law consciousness and responsibility consciousness; at the same time it is necessary to improve the participation ability and of netizens.
