摘要
虚拟产权式商铺热销过后随着回报期的到来,出现了很多问题:多种形式的经济纠纷、业主之间合作难题、政府维稳成本急增等。究其成因,是商铺产权虚设、禁止营销的法制规范效力低下、业主自治的民主困境。若要妥善解决上述难题,回归物权法基本原理,创新产权登记方式,以建筑物"单元"产权总体登记、虚拟分割商铺共有权登记变更为主要方式,并遵循物权运行规律,在"业主组织自治+政府外部监督为基本运行框架"范畴内,进行组织创新、机制创新、规则创新。
With the arrival of the investment return period,the crazy sale of virtual property-right store appears multiple diffi-culties like various forms of economic disputes,cooperation difficulties between the proprietors,rapidly increasing cost of govern-ment safeguard stability. Tracing to the reasons,mainly manifest following reasons like virtual property-right store,low legal effec-tiveness of prohibiting marketing,and democratic dilemma of proprietors5 autonomy. To properly solve the above problems,it needs to return to the basic principle of property law,to innovate the property registration,to alter the way of registration of title based on that building condominiums own the general registration and split the joint ownership,to abide the property law,and to conduct the organization innovation,mechanism innovation and rule innovation under the basic operation framework of the proprietors’ autonomy and the government external supervision.
