网络著作权边界问题探析

On the Boundary of Copyright in the Network Environment

著作权的边界问题是著作权制度最本质和基础性的问题。在传统自然权利理论的基础上,著作权的边界始终模糊不清。网络环境下,应将著作权置于权利能够和应该实现的范畴之内,把传统理论上认为属于创作者而被限制的权利划归回其应属的"公共领域"之中。基于功利主义和法定主义的理论基石,将著作权界定为文化产业领域的法定商业利益分享权,是著作权的本质属性所表现出来的必然结果,有利于网络环境下对著作权制度的重新构建,有利于解决网络环境下出现的各种棘手问题,同时也有利于通过著作权以外的制度模式,促进文化事业的发展。

The boundary of copyright is the most essential and fundamental problem of the copyright system.Based on the traditional theory of natural rights,the boundary of copyright has always been blurring.In the network environment,we should place the copyright in a category,whereby the right can and should be materialized;returning the right,restricted by authors based on traditional theory,to the public domain.Based on the theory of utilitarianism and legality,the copyright in the field of cultural industries should be defined as the legal right to share commercial interests.This is the inevitable result of the nature of property arising from copyright.It is beneficial to reconstruct the copyright system and to solve a variety of thorny issues under the network environment;and to promote the development of cultural undertakings by other modes beyond the copyright system.
