农地土壤污染治理公私协作法律机制探析

Discussion on the Legal Mechanism Constructs of EPPP′s Application in Soil Pollution Remediation of Agricultural Land

农地土壤污染已成为当前影响农村经济发展及农产品安全的主要问题。鉴于农地土壤环境问题呈现污染源分散、污染成因复杂等特征,及政府财政能力有限、技术匮乏等现实,具有汇集资源、分散风险和降低成本等优势功能的环境公私协作成为破解土壤污染治理困境的新思路。政府通过社会资本的引入及多元修复主体间的信任互惠网络,科学设定修复目标、合理分配修复责任及风险、实现农地土壤生态功能的优位保护。农地土壤污染治理公私协作法律机制,具体以"政府引导、平等协商及契约规范"为核心内容和法律手段。

Agricultural land protection is confronted with severe challenges from soil pollution,which is endangering agricultural products security and rural economies development. Considering the decentralized point pollution, increasingly complex pollution causes and limited capacities of government, the environment public-private partnership （EPPP） provides a new perspective to alleviate the difficulties faced by the contaminated soil remediation,through its advantages of pooling resources, spreading risks and scattering costs. Specifically, government ensured soil ecosystem functions by introducing social capital,which consists of t rus t ,reciprocal norms and networks,since EPPP allowed multi- subjects to set feasible goals and reasonable allocation of execution risks in soil repair process. In addition, the main contents and legal tools of EPPP＇s application mechanism are government guidance, equal consultation and contract regulations.
