The Influence of the Japanese Law to the Formation of Litigation System in Modern China

在很大程度上,近代中国诉讼制度是以日本法为媒介,引入和仿效大陆法系诉讼而完成的。这种不可忽视的日本诉讼法影响主要表现在两方面:一是在观念理论上,程序和实体、民事和刑事相分离,律师辩护及诸多法律术语等的日本引入;二是在法律规范上,修律参照系及民、刑诉讼法典等的日本仿效。

To a great extent, the litigation system of modern China introduced and followed the continental legal system through the Janpanese law. There are two considerable aspects of the influence of litigation system of Japanese law. One is in theory, including the introduce of the seperation of procedural and substantial law, as in civil and criminal law; layer pleading and legal jargons. The other is in legal norm, including the follow of the amendments of the civil and criminal law.
