关于消防行政委托执法的几点思考

Reflections on Delegating Fire Administrative Law Enforcement

为落实基层属地管理职责,夯实火灾防控基层基础,采取消防行政委托执法,实现"关口前移""重心下移",成为现有法律框架下解决乡镇(街道)执法困境的一条重要途径。但由于相关法律的不完善和其他各种因素,开展乡镇(街道)消防行政委托执法困难重重。为此,探讨了消防行政委托执法的具体做法,给出了完善消防行政委托执法的建议,以解决消防行政委托执法的法律依据、方式程序、事中监管及责任追究等相关问题。

To implement territorial management responsibilities and reinforce the foundation of fire safety at grass-root level,fire administrative law enforcement is delegated to achieve the ＂forward control＂and ＂downward focus＂,which has become an important way to solve the plight of law enforcement in towns（streets） under the existing legal framework.However,due to the imperfection of relevant laws and other factors,it is very difficult to delegate fire administrative law enforcement to the town（street） level.Therefore,it is necessary to explore specific practices and put forward some suggestions to perfect the practice of fire administrative law enforcement,so as to solve the problems of legal basis,methods and procedures,supervision and accountability,and other related issues in delegating fire administrative law enforcement.
