Accurate Determination of Putting Buildings into Use without Fire Administration's Authorization

针对一起群众举报住宅小区未经消防验收擅自投入使用的消防行政处罚案件,分析涉案开发公司、业主和公安机关消防机构在焦点问题上的不同观点。在综合论证的基础上,按照找准法律依据、现场核查取证、客观分析判定、合理合法处置四个步骤,剖析各种可能出现的情况,明确相关的法律依据和具体的法规条款,提出准确定性建设工程是否投入使用、是否擅自使用的程序。针对不同情况分别判定是否予以查处,并提出在处理类似建设工程群众举报案件时应注意的事项。

In this paper,the report of a residence building putting into use without authorization was discussed,and different views of developers,owners and the public security agencies on this issue are analyzed.On the basis of synthetic analysis and the four-step procedure-finding legal basis,verifying and collecting evidence on the spot,analyzing objectively,disposing reasonably and lawfully）,this paper analyzes all kinds of possible situations,puts forward a procedure in accordance with the legal basis and the specific terms of the laws and regulations to accurately determine whether the residence building is put to use without authorization,whether an investigate shall be conducted.This paper also puts forward some disposal tips when similar issues are reported by the public.
