合同治理在PPP项目中的应用研究

Research on the Application of Contract Governance in PPP Project

目前,在复杂的PPP项目实践中,单纯地应用基于项目管理技术和管理方法的项目管理理论已经难以满足项目绩效提升的需求,为解决PPP项目中涉及政府部门和合伙企业有关权责利等的保障和安排问题,从项目的制度层面入手,通过理论分析界定合同治理的内涵,基于合同治理理论,从政企双方的二元治理结构出发,探究PPP项目中的合同治理机制和合同治理的衡量维度,在此基础上,分析中国PPP实践中的典型案例——北京地铁四号线项目的合同治理过程,因此构建基于项目全过程的合同治理体系。

Recently,in the complex PPP projects＇ practice,simply applying the project management technology and management method of the project management theory has been difficult to meet the requirements of improving project performance. In order to solve the problem of the guarantee and arrangement of relevant rights,responsibilities and benefits for the government and the company,beginning from the institutional level,this paper defines the connotation by theoretical analysis first,and then explores the contract governance mechanism and the measure dimension of contract governance in the PPP project based on contract governance theory and two-dimensional governance structure of the government and the company. Based on these analyses, this study analyzes the process of contract governance of the typical case of PPP in China——the line No. 4 of Beijing metro. At last,this paper establishes the governance system for the whole process of the project.
