全面依法治国思想的法理学解读

党的十八届四中全会阐释了全面依法治国思想,实践中亟需形成一套严整有效的依法治国理论支持体系。因此,对全面依法治国思想进行法理学解读具有理论和现实的意义。全面依法治国的关键:建设法治政府;全面依法治国的基础:弘扬社会主义法治精神;全面依法治国的总价值:尊重和保障人权;全面依法治国的实施:抓住领导干部这个"关键少数";全面依法治国的总方针:依法执政;全面依法治国的总方向:中国特色社会主义法治道路。全面依法治国兼具治理革命和系统工程的特点,需要均衡各个治理维度,集全民之力共同推进。

The 4th Plenary Session of the 18th CPC Central Committee analyzed the idea of governing the country by law, and it is urgent to set up a set of rigorous and effective supporting theoretical sys- tem of governing the country by law in practice. Therefore, it is of great academic and practical im- portance to comprehensively interpret the spirit of governing the country by law from the perspective of Jurisprudence. The key of governing the country by law is to construct the government that is gov- emed by law. The base of comprehensive governing the country by law is to carry forward the social- ist spirit of rule of law. The total value of governing the country by law is respecting and guaranteeing the human rights. The comprehensive implementation of governing the country by law is grasping the ＂key minority＂ of leading cadres. The general policy of governing the country by law is governing by law. The general orientation of governing the country by law is the socialist road with Chinese charac- teristics. Governing the country by law has the features of governance revolution as well as systems engineering. It needs to balance every governance dimension and aggregate force of the people to jointly promote it.
